Terms of Service

These terms govern the use of the AutoKontor platform and the support offered to buyers. They may be updated; the applicable version is the one in force at the time of your request. These conditions govern USE of the website. As soon as an order is placed, the General Order Conditions apply, and they PREVAIL over the present document in the event of any divergence.

1. Purpose and role of AutoKontor

   Premium Choice Car GmbH operates AutoKontor and sells the vehicles presented on this site as a professional seller: the sale is concluded directly between the buyer and Premium Choice Car GmbH. Vehicles are sourced from partner dealerships in Germany; payment of the vehicle price may be made directly to the designated dealership, on AutoKontor's instruction, without this altering the identity of the seller or the warranties owed by it. Financing, where requested, is offered by authorised third-party credit institutions and insurance by third-party insurers: AutoKontor is neither lender nor insurer, and each of these services is the responsibility of the provider concerned.

2. Support

   Our team runs the file end to end: vehicle selection, arranging the viewing and test drive at the logistics centre, putting together the finance application, transport, formalities and follow-up through to final registration in your country. This support is covered by the flat service fee, the amount of which is given to you before you commit.

3. Prices

   Displayed prices are inclusive of all taxes, in the selected currency. The vehicle price and the flat service fee are two separate amounts, both stated on the quotation before you commit. Optional services are quoted separately. Currency conversions are indicative; only the euro amount is binding.

4. AutoKontor's remuneration

   AutoKontor is remunerated by a flat service fee, the amount of which depends on the vehicle price and is given to you before you choose that vehicle. This fee is a total, not a surcharge added along the way: it covers transport, formalities and follow-up of the file through to final registration. Added to it, where applicable and under a separate quotation, are the organisation of your trip if you collect the vehicle yourself, and any optional services you request. AutoKontor collects no other amount.

5. Reservation and availability

   Vehicle availability is updated regularly but is not guaranteed in real time: a vehicle may be reserved or sold in the meantime. A reservation becomes firm once confirmed in writing by AutoKontor.

6. Warranties

   Vehicles benefit from the statutory warranty of conformity owed by a professional seller, as well as, where applicable, the manufacturer's commercial warranty or any additional warranty taken out. As AutoKontor is the seller, this warranty is owed by AutoKontor. The precise conditions, duration and exclusions are given to the buyer before signature.

7. Liability

   AutoKontor uses every means to ensure the quality of the service and the accuracy of published information, without being able to guarantee the complete absence of error or site unavailability. Liability relating to the condition and conformity of the vehicle sold lies with AutoKontor, under the conditions provided by applicable law.

8. Governing law and disputes

   In the event of a dispute, an amicable solution will be sought as a priority; the complaint is addressed to us under article 20 of the General Order Conditions.\nThese conditions are governed by GERMAN LAW. Where the customer is a consumer resident in another Member State of the European Union, they retain the benefit of the mandatory protective provisions of the law of their habitual residence.\nFailing an amicable solution, the competent court is that of MUNICH where the customer is a business. Where the customer is a consumer, the statutory rules of jurisdiction apply: they may bring proceedings before the courts of their place of residence.\nAutoKontor is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

9. Financing and insurance

   AutoKontor is neither a credit institution, nor a licensed banking intermediary, nor an insurance intermediary. The financing simulator provides indicative, non-contractual estimates. Financing and, where applicable, insurance are offered exclusively by partner organisations and insurers, subject to their acceptance and their own terms. A loan commits you and must be repaid.
